What is Excision in Progress?

The first thing I want you to know is all land belongs to the government. Even a land with excision still belongs to the government. The government will revoke every right given on a land if it occupancy overrides public interest else in the case in which certificate of occupancy has been awarded to the owner of the land.


So what I am saying is even when you buy a land that already has an excision, the government might decide to still make use of it in the future, such cases where raw materials are discovered in the area and in many more cases where public interest is more than the individual or land occupant interest.  


Buying land with Excision is actually better than buying one without, but in any case whereby the government wants to make use of land with excision. The government has to pay you a fee like they are buying your land from you at the current market value of your land and the property on it.


Excision in progress

This group of words basically means the application of excision of the particular land has been filed in the ministry by the ancestral family who own the Land.

Most times this is used by real estate companies especially in ibeju Lekki area of Lagos State around the Lekki free trade zone and Epe town to deceive people that their plots of land will soon receive full Excision from the government.

In most cases what these real estate companies do is file for Excision from the government, get a file number and never proceed to finish or process their excision which they always called Excision in progress.


This is a rampart because most Estate or real estate companies just want to make a profit selling land as quickly as possible and move on to the next land to sell. This is just business as usual for most companies.

Should I buy land with Excision in progress?


This is a great question because most of the land for sale in Lagos State are actually without excision from the state government. less than 40% or 30% of the lands in Lagos State do have an Excision. While buying a land with the Excision is Great, Land without an excision are available more.


I know you are thinking, is it that the state doesn't want us to build or buy lands? The answers is No and these are steps to follow in buying a land:

The Surveyor should be paid to actually help you verify the status of the Land, The status of the Land should be a committed land or a land with excision or a land that is not committed and has no excision.


Even though a land is said to have an excision in progress, it can either be one of the three listed above either it is a committed land or a free land (not yet verified status).

A committed land is a no-go area, these lands are already subject to future government use, any property transaction or land transaction on parcel of land located in this area will be very risky.

But in the instance where such land have already been purchased, a surveyor should be contacted as soon as possible to start the documentation process and indicate the uniqueness of the purchased land in the plan and should also notify the lawyer of all uniqueness to be indicated in the deed of assignment.

Where a person will be very foolish is to buy any land from an estate location and allow the same person selling carry out documentation for them.

This should be totally avoided, no matter the ease of payment plan.


Any land that its status is not committed is still a good buy.


How To Fully Secure And Protect My Land After Buying:


The most important thing in buying a land is getting your surveyor to do the survey of the land after buying the land. This is actually more important than the receipt of the Land lol.

 for example when you buy a car from somebody you get a receipt from the person but you still have to get your own plate number from the government to know you are the owner of the car so that when the car is stolen it can be traced with the plate number, without the proper survey and documentation another person can claim to be the legal owner of the land.

Your land survey document is like your receipt of your car.
